The Ministry would like to have the ability to use information it considers relevant for assessing an application for a new (probationary) licence.
Currently, the decision as to whether to grant a probationary license is limited only to the information that is provided by the applicant.
Information held by the Ministry, including any previous breaches of the regulations, may not be brought to bear. Yet this is inconsistent with the ‘fit and proper’ assessment of the service provider allows the Ministry to consider any relevant matters when deciding to grant a licence. Hence, why the Ministry wants to clarity that it can use relevant information it has and not rely solely on the honesty or what information the applicant chooses to provide.
